Summary

The Italian DPA has imposed a fine of EUR 15,300 on Green Partner S.r.l.s. A data subject filed a complaint stating that they had received marketing phone calls despite being registered with a public opt-out register. Green Partner made these calls on behalf of the controller. The data subject then made a request to exercise their rights, which Green Partner, as the data processor, did not comply with. Furthermore the data processor could not provide the lawful origin of the data and contracted a third party to fulfil its obligations with the controller without being permitted to do so.
