Summary

The Spanish DPA has imposed a fine of EUR 3,000 on SILVANERGIA 2022, S.L. The controller, a service provider in the field of customer acquisition, had contacted data subjects by telephone for the purpose of acquiring customers. The controller obtained the data from a third party and was unable to demonstrate the legitimacy of its acquisition. Furthermore, the controller claimed to be calling on behalf of a third company, with which it had no contractual relationship. The original fine of EUR 5,000 was reduced to EUR 3,000 due to immediate payment and admission of responsibility by the controller.
